BEETHOVEN TRIAL EDITION LICENSE AGREEMENT

Licensed software, by approval. Beethoven is licensed, not sold: you receive a license to use it under the Trial Edition License Agreement below and the privacy statement, accepted once in a signing dialog on the extension's own setup page. The Trial Edition is free for approved institutional accounts during the evaluation period; a paid Full Edition, if offered, is a separate agreement. Nothing converts by itself and no payment details are taken for a trial. Ask for access with the account name your university's Open OnDemand portal shows for you; once you are approved the extension just works. There is no key and nothing to paste: your own sign-in to your portal identifies you, and the extension confirms your approval with the maintainer's access service when you connect and about once a day.

PLEASE READ THIS AGREEMENT. IT CONTAINS A DISPUTE-RESOLUTION SECTION WITH A NOTICE-AND-CURE REQUIREMENT, A CLASS-ACTION WAIVER AND A ONE-YEAR LIMIT ON CONTRACT AND WARRANTY CLAIMS (SECTION 19), A WAIVER OF JURY TRIAL (SECTION 20), A WARRANTY DISCLAIMER (SECTION 12), LIMITS ON LIABILITY AND AN EXCLUSIVE REMEDY (SECTION 13), AND AN ASSUMPTION OF NAMED RISKS (SECTION 8). THE TRIAL EDITION IS FREE OF CHARGE; YOU RECEIVE A LICENSE TO USE BEETHOVEN, NOT THE SOFTWARE ITSELF.

This is an agreement between Gregory Schwing, trading as OpenSpineConsortium ("Licensor", "we"), and you, the person whose institutional account is approved to use the Trial Edition ("you"). It is formed when, in the signing dialog Beethoven shows on its own page before first use, you tick the boxes, type your name and choose the button labelled "Accept and Continue". Beethoven records the version of this text you accepted, its hash, the time, what you ticked and the name you typed, and keeps a copy of the text for you. If you do not agree, choose "Decline" and do not use Beethoven.

1. WHAT BEETHOVEN IS

"Beethoven" means the browser extension of that name (the "Extension"), the scripts and programs it asks you to install in your own computing account on your institution's cluster, or that your institution's lab keeps in one shared copy which the Extension points your account at (either way, the "Framework"), the recipe for the container image the Framework runs, its documentation, and updates Licensor provides. The Extension starts, watches and stops a job in your own cluster account through your institution's Open OnDemand portal; the job runs Claude Code, Anthropic's program, which you have signed in to yourself, and makes that session visible to you at claude.ai and in the Claude app through Anthropic's Remote Control feature. "Trial Edition" means the edition this agreement covers: free of charge during the evaluation period, for persons whose institutional account Licensor has approved. "Full Edition" means the paid edition, if Licensor offers one, governed by the separate Beethoven Full Edition License Agreement, which you accept only if you choose that edition. "Your portal" means your institution's Open OnDemand portal, and "your account name" means the name that portal's dashboard shows for the session you signed in to; it is the only identifier Beethoven uses for you, and there is nothing to type or paste. "Named Dependencies" are the outside parties and conditions listed in section 7.

2. YOUR LICENSE, AND WHAT IT IS NOT

(a) Subject to this agreement, Licensor grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Trial Edition, free of charge, during the evaluation period (section 9(a)), in browsers you use and in computing accounts you are authorised to use, for your own research and study.

(b) Beethoven is licensed, not sold. You receive this license and no ownership of the software. The license can end as this agreement says (sections 3 and 9). All rights not granted are reserved.

3. APPROVAL AND WITHDRAWAL

(a) The Trial Edition is available only to persons whose institutional account Licensor has approved. Approval is requested on the request page at https://openspineconsortium.com/beethoven/request.html, with your account name, and may be refused or withdrawn at any time, with or without reason. There is no key and no password of Licensor's: your own sign-in to your portal identifies you. After you have accepted this agreement and connected your portal, the Extension asks Licensor's access service whether your account name is approved, when you connect, about once a day while it is in use, and again when you click its icon after a day has passed or after a no, and it starts a worker only while the answer is yes. A copy of Beethoven used from an account that is not approved does not start a worker; its panel offers a link to ask for access instead.

(b) Your approval is for you and the institutional account it names alone. Do not use Beethoven from an account that is not yours, and do not arrange for anyone else to use it under your approval.

(c) No payment is taken for the Trial Edition, nothing converts automatically into a paid license, and no charge follows its end. Beethoven contains the code that asks for and enforces approval; you may not disable, remove or work around it.

(d) Licensor may withdraw an approval that has been misused, given in error or obtained by misrepresentation, or for any other reason. Once your approval is withdrawn, the Extension stops starting workers at its next check and tells you so. Beethoven also checks its own version against a signed list of withdrawn versions; a withdrawn version stops sending commands and tells you to update.

4. YOUR ACCOUNTS AND THE TERMS THAT COME WITH THEM

Beethoven works with accounts and systems that are yours or your institution's, not Licensor's. You represent that you are the sole holder of, and authorised to use, each account Beethoven touches, and you agree to use Beethoven only in compliance with each of the following, as amended from time to time:

(a) your institution's rules for the institution's Open OnDemand portal and computing systems, including its acceptable-use policy, its high-performance-computing policies and any guideline it publishes on the use of AI tools; in particular, nothing beyond a job submission may run on a login node, and every job must carry a wall-time limit;

(b) Anthropic's Consumer Terms of Service, Usage Policy and the Claude Code terms, including the terms for Remote Control, for your Claude account: one person, one account; no sharing of credentials; no use of another person's account;

(c) the terms of the browser you use and of the store you obtained the Extension from (Google, Microsoft, Mozilla or Apple).

Breach of any of them is a breach of this agreement. Licensor is not affiliated with, endorsed by or acting for your institution, Anthropic, Google, Microsoft, Mozilla, Apple or the Open OnDemand project, and none of them is a party to this agreement.

5. WHAT BEETHOVEN DOES WITH YOUR CREDENTIALS AND YOUR WORK

This section describes the software as shipped, so that you can hold Licensor to it.

(a) Claude. Beethoven never reads, stores, copies, prints or relays a Claude credential. You sign in to Claude Code yourself, through Anthropic's own flow, once, in a terminal on a compute node of your own cluster account. The Extension starts that terminal for you through your portal's shell, opens Anthropic's sign-in page in a new tab, and shows you one box; you sign in on Anthropic's page and paste the one-time code it shows into that box. The Extension types the code once into that terminal and keeps no copy of it: it is not stored, not written to the audit log and not sent to Licensor or anyone else, and the Extension never reads Anthropic's page or your clipboard to obtain it. Claude Code makes its credential from the code and keeps it in its own folder in your cluster account; the Framework only starts Claude Code where that credential already is, and Beethoven reads Claude Code's yes-or-no answer about whether it is signed in, nothing more. You use one Claude account, your own. You answer Claude Code's one-time question about Remote Control yourself, in the Extension's own panel, before your first worker starts; the Extension records that answer in one file in your cluster account, and your worker gives it to Claude Code when Claude Code asks. Trust for the worker's own folder is recorded in Claude Code's settings by the Framework when a worker starts. Beethoven gives Claude Code no answer you have not given.

(b) Your portal session. The Extension uses the sign-in your browser already holds for your institution's Open OnDemand portal, on that one website only, in the same way the portal's own pages do. It never reads the sign-in cookie, never stores a portal password, never signs in for you and never touches a multi-factor step. When the portal asks for a sign-in, the Extension asks you to sign in in a tab. The one thing it reads about you from the portal is your account name, from the portal's own dashboard page.

(c) Your account name, as the portal's dashboard shows it, and the answer of the last approval check with its time are stored in the Extension's own storage in your browser. Nothing about your approval is copied to your cluster account; the Framework has no key, password or account list of Licensor's.

(d) The Framework makes a random token for each job so that only your own browser session can reach your worker. It is kept in a file only you can read, is never shown, and never appears on a command line or in a job log.

(e) Where your work goes. Files the worker reads and every command's output are sent to Anthropic. While you are connected through claude.ai the transcript is also stored on Anthropic's servers. A personal plan is retained five years if model training is on and 30 days otherwise. No BAA covers a personal plan. FERPA records, IRB data and export-controlled technical data must not be in the working directory. Remote Control usage draws from your plan's shared limit. The Extension shows these sentences at first run and before each job start, and does not start a worker in a folder you have marked restricted.

(f) The Extension runs no code on claude.ai or any other Anthropic page and reads nothing from them. Its only page script runs on the one portal website you connect. It opens an Anthropic page only in a new tab, as a bookmark would: the sign-in page during the sign-in described in (a), your worker's session page when the worker connects, and the connectors settings page if you choose the optional Google Drive step.

(g) Of (a) to (f), only your account name in (c) is sent to Licensor, in the approval check that section 10 describes; nothing else is. Section 10 describes the only things that may be.

6. RESTRICTIONS

Except as this agreement allows, or as applicable law permits despite this section, you must not:

(a) copy Beethoven beyond what installation, use and one backup need;

(b) distribute, publish, rent, lease, lend, sublicense or otherwise make Beethoven available to anyone else, or let anyone else use it under your approval;

(c) modify, adapt, translate, decompile, disassemble or reverse engineer Beethoven, or create works derived from it. This does not limit what 17 U.S.C. 1201(f) (interoperability), 17 U.S.C. 1201(j) (security testing), the security-research exemption in 37 C.F.R. 201.40, or other law that cannot be contracted away, allows you to do;

(d) disable, remove, bypass or interfere with the approval check, the list of withdrawn versions, or any other technical measure in Beethoven, or help anyone else do so;

(e) remove or alter any copyright, license or other notice in Beethoven;

(f) use Beethoven to build a product or service that competes with it;

(g) use Beethoven in breach of section 4, or for any clinical purpose (section 11), or in any setting where its failure could cause injury or damage to property.

Items (b), (c) and (e) are conditions of the license in section 2; the others are promises you make. Nothing in this agreement restricts you from giving an honest review or assessment of Beethoven, and Licensor claims no right in such a review beyond permission to quote it.

7. NAMED DEPENDENCIES: THE OUTSIDE THINGS BEETHOVEN NEEDS

Beethoven works only while all of the following hold. None of them is within Licensor's control, and each is disclosed here, in the signing dialog and where Beethoven is offered, so that you can decide with this in mind:

(a) your institution keeps your account, your access to its network (including any VPN it requires), its Open OnDemand portal with its shell, files and jobs features and, where used, its reverse proxy, and its computing systems; and its policies, firewalls, maintenance windows, queue rules and job limits allow what Beethoven does;

(b) Anthropic keeps offering Claude, Claude Code, its sign-in flow, the subscription plan you hold and Remote Control on terms that permit your use, keeps your plan eligible for Remote Control, and does not change, limit or enforce them against your account or your pattern of use;

(c) the browser you use and the store you obtained the Extension from keep the Extension available, compatible and enabled, and do not remove or disable it;

(d) you keep your own accounts, do not share them, and keep your sign-ins current;

(e) the internet connections between your browser, your institution's systems and these services work.

Licensor may also stop offering Beethoven, the Trial Edition or a version of either at any time, as section 9 says.

8. ASSUMPTION OF RISK

You choose to use Beethoven knowing section 7. You accept the risk that any Named Dependency fails or changes, that Beethoven stops working as a result, and that work you had running, files you had in a worker's session, or time you had planned may be lost or delayed. In particular, and as Known Risks named in the signing dialog, you accept the risk of these three events, which are specific to how Beethoven works: Anthropic changing or enforcing Remote Control eligibility; your university disabling or reconfiguring Open OnDemand's shell, files or reverse proxy; and a browser store removing or disabling the Extension. You agree that such an event is not a defect in Beethoven, not a breach of this agreement by Licensor, and gives no claim against Licensor. This section is one of the terms you specifically acknowledge in the signing dialog. It does not cover loss caused by Licensor's own gross negligence, wilful misconduct or fraud.

9. EVALUATION PERIOD, SUPPORT, NO FEES, AND THE FULL EDITION

(a) Evaluation period and term. The evaluation period runs from your acceptance until the earliest of: the withdrawal of your approval, including the end of an approval that was given for a limited time; and the date Licensor ends the Trial Edition, of which Licensor gives at least 30 days' notice inside Beethoven or on the support page. This agreement lasts for the evaluation period and terminates automatically if you breach it. When it ends you must stop using Beethoven and delete it, unless you have accepted the Full Edition agreement, in which case that edition's agreement governs. Sections 4 to 8 and 10 to 23, and anything else that by its nature should survive, survive.

(b) Support. The Trial Edition comes with the documentation and the support page. Licensor may help with using Beethoven as designed, at its discretion and with no response-time promise; support does not include restoring a Named Dependency.

(c) No fees, no refunds, no remedy for outages. Nothing is owed for the Trial Edition, nothing is paid, and therefore nothing is refunded. When Beethoven stops working because of a Named Dependency, or because Licensor withdraws approval, changes or ends the Trial Edition, you have no claim against Licensor; Licensor will, where practical, restore access once the dependency works again.

(d) The Full Edition. If and when Licensor offers the Full Edition, you may continue with the Trial Edition for as long as Licensor offers it, or take up the Full Edition by accepting the Beethoven Full Edition License Agreement in the signing dialog. Doing so is your choice; nothing in this agreement obliges you to buy anything, and no Trial Edition data or record is used to charge you. On Safari, where Apple's rules do not allow an app to unlock features outside Apple's own purchase system, any Full Edition is offered free or through an in-app purchase instead.

(e) Nothing in this section limits rights that consumer law gives you and does not allow you to waive, including under the Michigan Consumer Protection Act.

10. WHAT LICENSOR RECEIVES, ACCESS RECORDS AND PRIVACY

(a) The approval check. Only after you have accepted this agreement, and only once your portal is connected and your account name is known, the Extension asks Licensor's access service (https://beethoven-access.openspineconsortium.workers.dev) whether that account is approved: when you connect, about once a day while it is in use, and again when you click the Extension's icon after a day has passed or after a no. Each check sends, over an encrypted connection and without cookies, your account name as your portal's dashboard shows it, your portal's hostname, the product name, the Extension's version and, as any request does, the time it was made. The service answers yes or no. Licensor's service records each check: those items, a salted hash of your network address (never the address itself) and the answer. The Extension keeps a yes for up to a day, and for up to seven days when the service cannot be reached, so that an outage on Licensor's side does not stop your work; it keeps a no for ten minutes.

(b) Two files. Once a day, and only after you have accepted this agreement, the Extension also fetches from Licensor's website a small file naming the address of the access service (https://openspineconsortium.com/beethoven/services.json) and a signed list of withdrawn versions (https://openspineconsortium.com/beethoven/killlist.json). Those requests are sent without cookies and carry nothing about you beyond what any web request carries (your network address). The check in (a) and these two files are the only requests the Extension makes to Licensor.

(c) The Extension sends no error reports, no crash reports and no usage data, and there is no activation step: it has no code for them and no address to send them to. Your acceptance record (the version and hash of this text, what you ticked, your typed name, the time, the install id, the software versions), your statements, your audit log and your settings stay in your browser; Licensor does not receive them.

(d) Access records. An access request on the request page records what you enter there (your account name, your name, your institutional e-mail, what you will use Beethoven for). Licensor's own records hold the approval and withdrawal decisions about your account, with the name and e-mail given and their dates, and the record of each approval check described in (a). Licensor keeps these records for the life of your access and six years after, to prove the license and its terms.

(e) The full privacy statement is in PRIVACY.md, which forms part of this agreement.

11. NOT FOR CLINICAL OR HIGH-RISK USE, AND NOT FOR RESTRICTED DATA

Beethoven is a research and teaching tool. It is not a medical device and must not be used for diagnosis, treatment or any other clinical decision, or as a source of medical advice, or in any setting where its failure could cause injury, death or damage to property. Because of section 5(e), it must not be used on protected health information, FERPA-protected education records, data collected under an IRB protocol that has not approved this use, or export-controlled technical data.

12. NO WARRANTY

BEETHOVEN IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT THE LAW ALLOWS, LICENSOR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT BEETHOVEN WILL WORK WITHOUT ERROR OR INTERRUPTION, THAT IT WILL WORK ON ANY PARTICULAR COMPUTING SYSTEM OR WITH ANY PARTICULAR SERVICE, OR THAT THE NAMED DEPENDENCIES WILL HOLD. THIS AGREEMENT MAKES NO WRITTEN WARRANTY OF PERFORMANCE. SOME STATES DO NOT ALLOW SOME OF THESE DISCLAIMERS; TO THAT EXTENT THEY DO NOT APPLY TO YOU.

13. EXCLUSIVE REMEDY AND LIMITATION OF LIABILITY

(a) Exclusive remedy. For any claim about Beethoven or this agreement, your sole and exclusive remedy is correction of the problem or, at Licensor's choice, the end of your access, which Licensor can always perform. No fee is paid for the Trial Edition, so no refund arises.

(b) TO THE FULLEST EXTENT THE LAW ALLOWS, AND WHETHER OR NOT THE REMEDY IN (a) IS HELD TO FAIL OF ITS ESSENTIAL PURPOSE, LICENSOR IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, COMPUTING TIME, RESEARCH RESULTS, ACCOUNT ACCESS, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO BEETHOVEN OR THIS AGREEMENT, HOWEVER CAUSED AND UNDER ANY THEORY. LICENSOR'S TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS LIMITED TO THE GREATER OF THE FEES YOU PAID FOR BEETHOVEN IN THE TWELVE MONTHS BEFORE THE CLAIM (WHICH FOR THE TRIAL EDITION IS NOTHING) AND ONE HUNDRED US DOLLARS.

(c) These limits do not apply to liability for gross negligence, wilful misconduct, fraud, death or personal injury, or any other liability that the law does not allow to be limited.

14. INDEMNITIES

(a) You will defend and indemnify Licensor against claims by third parties, and the resulting losses and reasonable costs, to the extent caused by your breach of section 3, 4 or 6 or by your misrepresentation under section 4 or 21, and not by Licensor's own negligence or breach.

(b) Licensor will defend you against a third-party claim that Beethoven itself (not the open-source components, and not your use of it in breach of this agreement) infringes that party's copyright or trade secret, and pay the damages finally awarded, subject to section 13, provided you tell Licensor promptly and let Licensor control the defence.

15. OWNERSHIP, OPEN-SOURCE COMPONENTS, FEEDBACK AND NAMES

Beethoven is protected by copyright and other laws; Licensor and its licensors keep all right, title and interest in it. Beethoven bundles open-source packages listed in THIRD_PARTY_NOTICES.md; each is licensed to you under its own license, which this agreement does not limit. Claude Code, Node.js, the container image, the container runtime and the Open OnDemand portal are not part of Beethoven: they are provided by their own publishers or by your institution under their own terms. If you send Licensor suggestions about Beethoven, Licensor may use them without obligation. Beethoven runs Claude Code and is not an Anthropic product; "Claude" and "Claude Code" are Anthropic's marks, used here to say what it runs; "Open OnDemand" is the mark of its publisher. Your institution's names and marks belong to it, and Beethoven carries none of them.

16. SECURITY AND BREACH NOTICE

Licensor keeps reasonable security measures for the systems that hold access records, and will notify you as Michigan law (MCL 445.72) or the law of your state requires if a breach affects your personal information held by Licensor. This duty is Licensor's and is not shifted to you by anything else in this agreement.

17. UPDATES AND CHANGES TO THESE TERMS

Updates to the Extension are distributed through the store you obtained it from (for Safari, the App Store); an extension installed by hand from a file does not update itself. A Framework installed in your own cluster account is updated only when you run the update the Extension offers, never on its own. Where your institution's lab keeps one shared copy of the Framework, the lab updates that copy, your next worker start uses it, and the Extension shows the version in use under Details. Each version ships the terms that apply to it. Licensor may change these terms for future versions. A change is never effective merely by being posted: Beethoven shows a changed agreement in the signing dialog and asks you to accept it again, by the same steps, before the new version is used. A change to section 19 or 20 applies only to disputes that arise after you accept it. If you decline a changed agreement, you may keep using the version you accepted for as long as your approval and the evaluation period last, or stop using Beethoven; earlier acceptance records are kept.

18. EXPORT AND SANCTIONS

You must comply with the export-control and sanctions laws that apply to you. You represent that you are not located in, and will not use Beethoven in, a country or region subject to a comprehensive US embargo, and that you are not on a US government restricted-party list. The Extension contains cryptography used only to verify signatures; the Framework generates random per-job tokens.

19. DISPUTES: NOTICE FIRST, THEN INDIVIDUAL CLAIMS IN MICHIGAN COURTS

Please read this section; it affects how disputes between you and Licensor are resolved and is one of the terms you specifically acknowledge in the signing dialog.

(a) Notice and 60 days to fix it, before any lawsuit. Before starting any lawsuit or other proceeding, the party with a claim sends the other a written notice, signed by that party personally, stating their name, the e-mail in the access record, the install id shown with the acceptance record on the Extension's setup page, what the problem is and what outcome they want. Notice to Licensor goes to the notice address on the support page at https://openspineconsortium.com/beethoven/support.html; notice to you goes to the e-mail in your access record. The parties then have 60 days to resolve it in good faith, including one telephone or video call if either asks. Completing this paragraph is a condition of bringing any claim other than in small-claims court; a court may decide, at either party's request, whether it was completed. Any time limit that applies to the claim, including (e), is paused from the day the notice is sent until the 60 days end. Licensor owes you the same notice and the same 60 days.

(b) Where. Any lawsuit or proceeding arising out of or relating to Beethoven, your access or this agreement is brought only in the state courts sitting in Wayne County, Michigan, or the United States District Court for the Eastern District of Michigan, and both parties consent to their jurisdiction, except that (1) either party may bring an individual claim that qualifies in the small-claims court of the county where you live, and (2) you may bring a claim where you live where the law of your state gives you that right and does not allow it to be waived.

(c) CLASS-ACTION WAIVER. YOU AND LICENSOR EACH AGREE TO BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. Every individual remedy the law gives you remains available to you individually. If a court holds this paragraph unenforceable for a particular claim, it is severed for that claim only and the rest of this agreement stands.

(d) Fees. Each party pays its own lawyers, except that in a proceeding other than small claims the court may award the prevailing party its reasonable attorney fees and costs; this does not displace any award a statute gives you.

(e) One year to bring contract and warranty claims. Any claim for breach of this agreement, or for breach of warranty, must be brought within one year after it arose, or it is barred; the period is paused as (a) says. This paragraph does not apply to claims under a consumer-protection statute or to any claim whose period the law does not allow to be shortened.

(f) Governing law. This agreement and any dispute are governed by the laws of the State of Michigan without regard to conflict-of-laws rules, except that the consumer-protection law of the state where you live applies to you where that law says it cannot be displaced.

(g) No arbitration in this version. Disputes go to court as this section says. Licensor may offer arbitration in a future version; it would apply only if you accept that version by the steps in section 17.

20. WAIVER OF JURY TRIAL

TO THE EXTENT THE LAW ALLOWS, YOU AND LICENSOR EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO BEETHOVEN, YOUR ACCESS OR THIS AGREEMENT. A CLAIM WILL BE DECIDED BY A JUDGE. This section is one of the terms you specifically acknowledge in the signing dialog.

21. YOUR STATE'S RIGHTS, AND AGE

(a) Nothing in this agreement takes away a right that the law of your state gives you and does not allow to be waived. No provision of this agreement is void, unenforceable or inapplicable in your state unless this section or that law says so.

(b) New Jersey residents: sections 12 and 13 do not limit Licensor's liability for its own fraud, wilful misconduct or gross negligence, or your rights under the New Jersey Consumer Fraud Act; section 19(e) does not shorten a period that New Jersey law does not allow to be shortened; and section 20 applies only to the extent New Jersey law allows.

(c) California residents: you may make any statement you wish about Beethoven (Civil Code 1670.8); nothing here waives public injunctive relief that California law does not allow to be waived; a notice under section 19(a) that meets the form of the Consumers Legal Remedies Act counts as the notice that Act requires; and section 2(b) is the license disclosure Business and Professions Code 17500.6 requires.

(d) Texas and Massachusetts residents: your rights under the Deceptive Trade Practices Act and chapter 93A, including their notice procedures, are not waived; section 19(a) runs alongside them.

(e) Where a state requires a written waiver in a particular form for a particular right, and this agreement does not meet that form, that right is not waived.

(f) Age. You must be at least eighteen years old to accept this agreement. A person under eighteen may use Beethoven only if a parent or guardian accepts this agreement on their behalf in the signing dialog and remains responsible for their use. Licensor does not invoke sections 19 or 20 against a person who was under eighteen when they accepted without such acceptance.

22. GENERAL

(a) Entire agreement; no reliance. This agreement, with PRIVACY.md and THIRD_PARTY_NOTICES.md, is the entire agreement between you and Licensor about the Trial Edition and replaces any earlier terms for the versions it covers, and anything said in a listing, a README, a demonstration, a post or a conversation. If you later accept the Full Edition agreement, it replaces this one from that moment. You have not relied on any statement about Beethoven that is not written here or in the documentation shipped with it. Licensor does not promise any particular result from using Beethoven, any particular availability of a Named Dependency, any continuation of the Trial Edition, or any particular response time. This paragraph does not exclude liability for fraud.

(b) Severability. If any part of this agreement is unenforceable, the rest remains in effect, subject to section 19(c).

(c) Assignment. You may not assign this agreement; Licensor may assign it to a successor to the Beethoven business or to an entity Licensor controls, with notice to you.

(d) No waiver; no oral changes. A failure to enforce a term is not a waiver of it. This agreement changes only as section 17 says.

(e) Notices. Notices to you go to the e-mail in your access record and, where practical, inside Beethoven; notices to Licensor go to the notice address on the support page at https://openspineconsortium.com/beethoven/support.html.

(f) Electronic records. You agree to receive this agreement, the privacy statement and notices electronically; you can save and print them, and you may withdraw this consent by stopping use of Beethoven. To read them you need a web browser. You may ask for a paper copy at the notice address.

(g) Headings and language. Headings are for convenience. Where this agreement is translated, the English text governs.
